Vladimir Putin, speaking in the Kremlin on November 28, 2017 at a meeting on the implementation of the National Strategy for Children, proposed introducing additional opportunities for using maternity capital from 2018 - namely, issuing funds to needy families using a certificate monthly cash payments at the birth of a second child before he reaches the age of 1.5 years in the amount of the subsistence minimum established in the region (in 2018, the average for Russia will be 10500 rub.).

Conditions for receiving monthly payments from maternity capital

The payment will be provided to families living in Russia, using the same targeted approach, according to which, starting from 2018, new payments will be made, namely:

Moreover, if you apply for payments before the child turns 6 months old, the benefit will be accrued from the date of birth of the child, and if you apply later than six months after birth, then payments will only be assigned from the moment of application excluding missed months.

All these conditions are enshrined in law “On monthly payments to families with children”, which was submitted to the State Duma on December 6, 2017, signed by the president on December 28, 2017 and came into force on January 1, 2018 (see document below).

An additional document that regulates appointment procedure payments and establishes list of documents, is the order of the Ministry of Labor dated December 29, 2017 No. 889n.
You can submit an application and documents for assignment of payments for your second child at the territorial office of the Pension Fund, you can also do this through the MFC or the State Services website, and it is also possible to send documents by mail.

Income of family members received in cash, which taken into account to determine eligibility to receive benefits:

  • wages (including bonuses) and income from business activities;
  • pensions, benefits, scholarships and other similar payments;
  • allowances for military personnel, employees of the Ministry of Internal Affairs, civil servants;
  • insurance pension payments to legal successors of deceased persons.

In this case, income from the rental of real estate and interest on bank deposits, as well as one-time financial assistance from the state received in connection with natural disasters, terrorist attacks and other emergency situations, will not be taken into account.

The amount of maternity capital due under the certificate will decrease monthly in the amount of the payment received. In addition, payments are not mandatory, that is, they will not be paid automatically if the person does not submit the appropriate application and does not provide the necessary package of documents.

Payment amount (table)

The exact amount of monthly payment from maternity capital in 2018 installed individually in each individual region of residence (see below). However, due to the fact that inclusively, Vladimir Putin announced back in November national average size new benefits for needy families immediately for the next 3 years (it will be exactly the same as it was announced by the President):

  • in 2018 - 10,523 rubles;
  • in 2019 - 10,836 rubles;
  • in 2020 - 11,143 rubles.

At the same time, in different regions the amount of payments differs significantly- from a maximum of 22,222 rubles in the Chukotka Autonomous Okrug to a minimum of 8,247 rubles in the Belgorod region (see more details in). Accordingly, in the first case, over the envisaged 1.5 years, almost the entire amount of the certificate will be spent on payment by the family (399,996 out of 453,026 rubles), and in the second, only a third of it (148,446 rubles), which will allow the remainder to be used.

The maximum family income at which you can receive payments from maternity capital for a second child from 2018 is indicated in the table before income tax. Those who have never received a one-time payment in the established amount can easily receive it, but for this they need to become a participant in the maternity capital program.

However, many people ask the question: “Is it possible to get 25,000 from maternity capital a second time?” Unfortunately, you cannot become the owner of this amount again.

Repeated issuance of a one-time payment is prohibited by law and is unacceptable, since it is a direct contradiction of the regulatory act number 256.

The second step is submitting an application and a package of documents to a branch of the Pension Fund or a multifunctional center. Upon review of your papers, you will either be denied participation in the program, or, on the contrary, will be given the go-ahead.

Once you have received the certificate, you can proceed to further actions. Namely, you can now draw up a corresponding application, a sample of which you can see in the branch of the pension fund or on information resources.

To protect motherhood, childhood and family values, the state is taking a number of measures aimed at improving the standard of living and financial support for citizens.

Perhaps the most popular of them is the federal “Maternity Capital” program, which has been in effect since 2007. It is perceived by many as the only breakthrough success of Russian socio-economic policy in the 2000s.

Is there maternity capital in 2017?

In 2017, the federal program “Maternity Capital” celebrates its 10th anniversary (Federal Law No. 256 of December 29, 2006 has been in force since January 1, 2007). During this time, it became a financial aid for almost 4.2 million families (they used the funds; there are a total of 7.3 million certificates) in which a second or any subsequent child was born. The amount of capital has doubled, and the possibilities for its use have expanded. Maternity capital had a mostly positive effect on its main goal - increasing the birth rate - and played the role of another social security instrument.

In 2016, by decision of the President, the program was extended until December 31, 2018 (Federal Law No. 433 of December 30, 2015). A number of changes have been made to the legislation, which will speed up the transfer of funds for targeted needs. On the other hand, the indexation of maternity capital was suspended until 2020 (Federal Law No. 444 of December 19, 2016), while the possibility of taking advantage of a one-time cash payment in 2017 is still in question.

Changes have been made to the procedure for obtaining a maternity capital certificate. Thus, according to Decree of the Government of the Russian Federation No. 253 of March 3, 2017, the period for transferring money in favor of financial, educational and other organizations will be reduced from 30 to 10 working days. At the same time, the period for consideration of an application for the use of maternal capital by the Pension Fund is, as in 2016, one month.

This change will allow, first of all, to quickly close real estate transactions (since most of the funds are used to obtain a mortgage). In many cases, this will reduce the debt obligations of families who have taken out loans from credit cooperatives. The interest on them is up to 1% per day.

Since 01/01/2017, there have been changes in the legislation relating to state registration of real estate. Thus, old cadastral passports and certificates of ownership are replaced by an extract from the Unified State Register of Real Estate. When receiving maternity capital, the family must take this innovation into account and request an extract from the local branch of Rosreestr (RUB 750 on paper).

Otherwise, the program continues to operate under the same conditions:

  • the certificate is received only once in a lifetime; the right to it arises from the birth or adoption of the second or any subsequent child from 01/01/2007;
  • Capital is used in 4 main areas. It is expected that by the end of 2017 it will be possible to receive lump sum payments in cash;
  • funds can be used after the child turns 3 years old. The exception is the purchase of mortgage real estate and social adaptation (payment for medical, developmental goods and services) of disabled children.

The mother (adoptive mother) has priority when receiving family capital. The following conditions apply:

  • the second or any subsequent child was born or adopted after January 2007. The rule does not apply to stepdaughters and stepsons: the program is also aimed at finding orphans a new family. According to legislators, a child of one spouse adopted by the other already has it. Guardians are also deprived of the right to maternity capital;
  • mother and baby are citizens of the Russian Federation;
  • the mother is not deprived of parental rights, has not committed or been prosecuted for crimes against the person, and has not used MSK before.

The right to family capital is the father who is the sole adoptive parent of the second or any subsequent child, or who is left alone after the death of the mother, deprivation of her parental rights, or her commission of crimes against the person. In the latter case, the citizenship of the father is not important - the only thing that matters is that the mother acquired the right to capital at birth.

The right to receive MSK is “inherited” to children under 18 years of age (23 if they are studying full-time at a Russian university) if their parents have died, been deprived of their rights, or the mother has died and the father is not their own.

Where can I get a certificate for MSK?

The functions of issuing certificates and directing funds for targeted needs are the responsibility of the Pension Fund of the Russian Federation and its territorial divisions. This is where you need to submit documents and an application to receive and use MSK.

For convenience and unification of data throughout the country, the Pension Fund maintains a unified register of certificates. Thanks to this, the mother can contact any branch of the Pension Fund, not only at her registration address.

There are several ways to apply for family capital:

  • personally to the territorial division of the Pension Fund. Reception is by appointment, available by phone and through the official website;
  • by mail, and all documents must be notarized copies;
  • remotely using an electronic digital signature through the government services portal or the Pension Fund website;
  • at the MFC.

It is possible to submit an application by a representative using a notarized power of attorney.

Application and documents for the MSK certificate?

The application for maternity capital must contain:

  • detailed information about the recipient. They are filled out on the first sheet and include items about biographical and passport data, citizenship, SNILS number, representative;
  • information about natural and adopted children with the date and place of their birth, citizenship, certificate details;
  • information about certificates received previously (always “Not issued”), about facts of deprivation of parental rights and the commission of crimes against the person.

The following documents must be prepared along with the application:

  • recipient's passport (for those living abroad - international passport);
  • birth certificates of all children (a mark on citizenship is affixed to the certificate. If it is not there or the child was born abroad, a certificate from the Main Directorate of Migration Affairs of the Ministry of Internal Affairs is required);
  • a judicial act on adoption that has entered into force.

In special cases served:

  • child's death certificate. If the baby was born alive and lived for more than 5 days, the mother receives the right to family capital;
  • confirmation of the right to MSC in the event that it passes to the father or children-heirs (death certificates of the mother, orders to deprive her of parental rights, verdict on the fact of committing a criminal offense, etc.);
  • notarized copies of documents in a foreign language, if the recipient became a citizen of the Russian Federation as a result of naturalization.

The Pension Fund makes a decision on issuing or refusing to issue a certificate within a month. He notifies the mother of this at the address indicated in the application. After 5 days, you can pick it up in person at the Pension Fund office, MFC (if documents were submitted there), by mail or electronically.

Size and indexation of maternity capital in 2017

The amount of family capital will not change until 2020. Thus, it remains at the 2015 level and amounts to 453026 rubles. The abandonment of annual indexation according to inflation growth was caused by the economic crisis in the country and the budget deficit for 2017.

Indexation was carried out annually until 2015. If maternity capital was received earlier but not spent, the amount in 2017 will be 453026 rubles. The increase concerned only the balance of funds in the account.

So, for example, the mother issued a certificate in 2010 in the amount of 343,379 rubles. and then received a one-time cash payment in the amount of 12 thousand rubles. In 2011, 331,379 rubles were indexed. Thus, in 2017, she can spend 437,193 rubles on targeted needs.

The Pension Fund annually sends out information letters to MSC owners about the account balance. Since 04.2016, it can be found on the official Internet resource of the Pension Fund through the Unified Register of Certificates by its number.

Use of maternity capital in 2017

Family capital in 2017 is used in 4 main areas. This:

  • acquisition of new or reconstruction of old real estate;
  • payment for education of any child at a Russian university;
  • Mom's funded pension. The most unpopular direction, since by “freezing” the indexation of funds accumulated in funds, the government has practically reduced the idea of ​​a funded pension to zero;
  • social adaptation of disabled children.

Periodically (in 4 years out of 10) the state allows you to cash out part of the MSC funds. It is not yet clear whether there will be payment from maternity capital in 2017.

Adaptation as an area of ​​using MSK has appeared relatively recently - since 2016. It includes payment for goods and services in medical, developmental, and rehabilitation institutions necessary for the social and technical integration of a disabled person into society. The full list was approved by Government Decree No. 831-r. Permissions to use MSCs for adaptation are issued by the regional health committee, social protection department and ITU.

In this area, as well as to make a down payment on a mortgage or repay a loan, family capital can be used ahead of schedule - before the baby’s 3rd birthday.

Maternity capital in 2017: one-time payment

The one-time payment from maternity capital in 2017 is a real bone of contention between the economic (represented by the Ministry of Finance and the Ministry of Economic Development) and social (represented by the Ministry of Labor) bloc of the government. Both are responsible for developing recommendations on the advisability of cashing out part of MSC funds. The Ministry of Labor, based on ordinary Russians and, accordingly, the need for real help “here and now,” advocates allowing the payment. The Ministry of Finance and the Ministry of Economic Development claim that there is no money for this in the Russian budget.

As of May 2017, this issue has not yet been closed. Last year, the decision on one-time payments was made in April, and by the end of autumn, more than 2 million families took advantage of this opportunity.

According to experts, this year the law on payments will be adopted (if any) no earlier than September 2017, and the acceptance of applications and cashing out of part of the maternity capital will stretch until mid-2018. I would not like to think that the government is trying to close the issue with payments in this way immediately for 2 years.

Legislative initiatives on maternity capital

Every year, several initiatives regarding maternity capital arise in the Government and the State Duma. One of the latest is a bill that provides for monthly payments to the poor for the birth/adoption of each child (with an increasing amount) until they reach adulthood.

Since there is no free money in the budget, it is planned to replace cash payments with in-kind payments - a plot of land if there are more than 5 children in the family, or a car - for those who are raising at least seven children. This bill lasted for almost 2 months before it was repealed: according to forecasts, the state would spend much more than it does now, but would bring disproportionately less benefit.

In March 2017, a group of deputies from the United Russia proposed introducing another area for using maternity capital - for the purchase of a car. This measure of social support will become available to large families with disabled or adopted children. Since it will be possible to buy only Russian automatic telephone exchanges at MSC, legislators are thus trying to support also. The draft is being consulted by the State Duma Committee, but has little chance of adoption.

And the most joyful news for young mothers is that from 2018 it is planned to pay an additional 250 thousand rubles. in addition to MSC for those who gave birth to or adopted a second or any subsequent child under 35 years of age. It is proposed to give this money in cash, and it can be spent at the recipient’s choice.

All the proposed bills under consideration by the State Duma, if adopted, will put more pressure on the federal budget than the elementary indexation of the MCS according to the growth of inflation. Therefore, it is unlikely that the rules, procedure for obtaining and using, and the size of maternity capital will change significantly in 2017–2018.

During times of crisis, the government develops special programs to help rehabilitate the economy, combat unemployment and increase the country's well-being. In order to improve the standard of living of large young families, the state will allow them to receive a one-time payment from maternity capital in 2018 for the maintenance of children, equal to 25,000 rubles.

What is maternity capital

The government strives to improve the living conditions of citizens. For this purpose, a maternal (family) capital certificate (MCC) was introduced. Having received this document, adult family members will be able to exercise the right to financial support from the state. Indexation of maternity capital in accordance with the inflation rate was last carried out in 2015. The government is not going to change the amount of the lump sum payment in 2018. Several federal laws have been passed regulating the procedure for receiving money.

Parents will not be able to manage the money at their own discretion. The feasibility of providing part of the maternity capital is determined by the Pension Fund, based on the certificates provided. In citizens' requests, housing comes first, i.e. obtaining money for construction/purchase, reconstruction of housing or loan repayment. Maternity capital can be spent for the following purposes:

  • education of children in paid educational programs approved by the state;
  • payment for the maintenance of children in educational organizations;
  • payment for rented housing or dormitory while children are studying;

It is allowed to spend money on social adaptation and integration of disabled children into society. This term refers to all goods and services that are part of an individual rehabilitation program (IPRA). Money cannot be spent on paying for medical care for disabled children, described in Article 10 of Federal Law (FZ) No. 181 “On the social protection of disabled children in the Russian Federation.”

Is it possible to withdraw money from maternity capital in 2018

The one-time payment is an anti-crisis measure introduced in 2015. Previously, the family could not receive money from MSC for personal needs. They were used to improve living conditions, i.e. purchase or construction of real estate. In 2015, the legislation was changed, and since 2016, every family with 2 or more children can receive one-time financial assistance. The size of the benefit is not affected by the territorial factor.

A one-time payment from maternity capital in 2018 is provided under the same conditions as previously. On November 28, 2017, the President of the Russian Federation made a proposal to use MSC to help low-income families. If the amendment is adopted, then every month such citizens will be paid a certain amount of money. When calculating it, the regional cost of living will be taken into account. The family will need to confirm with the help of certificates that it belongs to the poor. Contributions will be received until the second child reaches 2 years of age.

Legal regulation of the issue

Article 5, Article 256-FZ contains information about who has the right to take advantage of social protection and obtain an MSK certificate. The regional program to support families and parents is implemented in accordance with this law. The application is considered by the Territorial body of the Pension Fund of the Russian Federation. Cash withdrawals are not possible. The certificate can be used for the purposes described in articles No. 10, 11, 11.1, 12 256-FZ, by bank transfer.

Information on how to get 25 thousand from maternity capital is contained in 181-F3. Based on this regulatory act, the Pension Fund of the Russian Federation is responsible for processing payments. A one-time payment can be received not only by parents or guardians, but also by children, provided they reach the age of majority or acquire full legal capacity before September 30, 2018. A citizen will be able to receive a payment if the capital has not been completely spent and if his guardians have not already used the financial assistance.

How much can you withdraw

The one-time payment is 25,000 rubles. Funds can only be received by bank transfer. Any methods of cashing out capital are illegal. An MSC owner who decides to receive money in this way becomes an accomplice to a financial crime and will no longer be able to participate in social government support programs.

Women who have a valid MSK certificate and have not lost their privileges to use state support measures can receive financial assistance from the state. Adoptive parents of children can use maternity capital if the parents cannot raise them due to death or deprivation of parental rights. The following can receive a one-time payment from MSC:

  • the father of the children in the event of deprivation of the mother's parental rights or her death;
  • a woman or man who adopted 2 or more children from a shelter;
  • official representatives of children after the death of parents or deprivation of their parental rights.

Financial assistance according to current federal laws is one-time. If all the money from the MSK certificate has been spent, then no additional amount will be allocated. The law does not provide for the possibility of re-issuing a lump sum payment. The procedure for exercising the right to receive financial assistance has not changed since 2016. The applicant must:

  1. Receive a certificate of maternal (family) capital.
  2. Fill out the application and collect the requested package of documents.
  3. Submit documentation to the agency responsible for the implementation of the state program.

Pension fund employees will definitely check the availability of the right to MSK. Money will not be issued without it. Processing of pension fund requests by law enforcement and judicial institutions will take 20-25 days. After confirming the applicant’s right to MSC and the absence of other burdensome factors, the government agency will make a positive decision on the request. A one-time payment will be sent to the account specified by the applicant.

According to the new version of the law, it is allowed to submit an application for payment along with an application for obtaining an MSK certificate. If you disagree with a negative decision of the Pension Fund of the Russian Federation regarding the issuance of financial assistance, a citizen has the right to write a complaint by visiting the territorial authority or sending it through the website. The application is written addressed to the head of the Pension Fund of the Russian Federation. You can make a complaint in the following situations:

  • the deadline for registering the application has been violated;
  • the application is considered for more than 1 month;
  • the applicant is required to provide documents that are not provided for by federal laws governing the rules for the provision of services;
  • refusal based on reasons not considered by federal laws and regulations of the Russian Federation;
  • requiring the citizen to pay a fee when filling out an application.

The complaint form indicates the name of the body, last name, first name, patronymic of the citizen, information about the actions/inactions being appealed, and the reasons why the applicant does not agree with the decision of the Pension Fund of the Russian Federation. Additionally, documents confirming the plaintiff’s arguments may be attached to the application. The period for consideration of a complaint is 15 days from the date of its registration. The applicant receives a response no later than 16 days from the date of registration of the application.

Today, government organizations do not accept documents for financial assistance. This is due to the fact that there is no official order to allocate funds from the MSC for one-time payments. The amendment must come into force by July 23, 2018. After this date, you can come to the MFC or pension fund with documents. Errors are rare when filling out an application. The form includes the following columns:

  • Fund name.
  • Last name (last name at birth is written in brackets), first name, patronymic.
  • Family status (guardian, mother/father).
  • SNILS certificate number.
  • MSK certificate number.
  • Who issued the MSK certificate and when.
  • Name, number of the citizen’s identity document.
  • Full address of place of residence.
  • Address of actual place of residence.
  • Information about the authorized person (if he is responsible for registration): last name, first name, patronymic, place of residence.
  • Name, number of the representative’s identity document.
  • Amount of payment (maximum – 25,000 rubles).
  • Details for transferring money: bank name, purpose of transaction, account number, INN, KP, BIC, corporate account.
  • Confirmation of the absence of offenses regarding children.
  • Description of all documents attached to the application.
  • Signature.

An employee of the pension fund or MFC must check the completed form. The information is verified with the data presented in the documents. The employee must put his signature and date of reception on the form. The application is assigned a registration number. With its help, you can track the progress of consideration of the request on the state online portal. After receiving the documents, the employee fills out a receipt. It indicates the last name, first name, patronymic of the owner of the MSK, the number and date of application, the last name and initials of the employee. It is kept by the applicant.

What documents are needed

To receive a one-time payment, a citizen must submit a completed application form, a sample of which can be found in the Pension Fund of Russia (PFR), a valid maternity capital certificate, an identity document, a certificate with an individual personal account insurance number (SNILS), birth certificates of children. When submitting a request remotely, the procedure will be as follows:

  • on the public services portal, following the example presented, the user fills out an application;
  • on the web page, the citizen indicates the passport number, SNILS and other personal data necessary to receive a one-time payment;
  • the user checks the completed form for the last time and submits it;
  • the application is checked on a general basis by the Pension Fund, and if approved, the payment will be provided in non-cash form to the account number specified in the completed documents.

Representatives of the Pension Fund of the Russian Federation advise citizens to apply for a one-time payment from maternity (family) capital through the public services portal. Documents sent in this way are immediately reviewed by the Pension Fund department, which is responsible for providing financial support to Russian families with children, so a decision on the request will come faster.

Where to apply for payment

Documents for a one-time payment from maternity capital can be submitted to the Pension Fund branch at the place of residence, to the multifunctional center (MFC) or electronic copies of them can be sent online through the public services portal. In the latter case, the citizen will have to undergo preliminary identity verification. To do this, you need to fill out a special form and confirm your personal SNILS number.

Citizens living in settlements remote from cities and without access to the Internet can send all documents by registered mail. Postal employees officially certify the fact and date of sending the application with attachments. With this method of submitting documents to the Pension Fund, the decision on the request must wait 2.5-3 months. The deadline for consideration of an application after its receipt by the department is 30 days. It will not be possible to receive payment in cash. The money is transferred to a bank account.

How to withdraw money from maternity capital again

Families who managed to receive a one-time payment equal to 20,000 rubles before November 30, 2016 will be able to submit another application for financial assistance in 2018. In other cases, re-issuance of money is not provided. One of the mandatory requirements to receive a payment equal to 25,000 rubles is to increase the size of the family by September 30, 2016. When adopting, all documents for the ward must be completed before this date.

Conditions of receipt

To withdraw money from maternity capital again, you must have a valid certificate. It must have financial resources. If the balance on the maternal certificate is less than 25,000 rubles, the family will receive only that. Under this program, no other additional payments to citizens are provided from the state budget. When applying again, you will need to submit the following package of documents:

  • valid MSK certificate;
  • SNILS;
  • a copy of the banking agreement;
  • passport;
  • documents confirming the identity of the applicant;
  • children's birth certificates;
  • adoption certificate if the child was taken from an orphanage.

Deadlines for submitting documents in 2018

You must submit your application through the online service or to one of the departments before November 30. A citizen must first obtain an MSK certificate. An application for disposal of part of maternity capital can be submitted in any month after 3 years from the birth of the second child. There will be no changes to this rule in 2018. If refused, 40-45 days after submitting the documents, the applicant will receive a letter with the reasons for the decision. The decision can be appealed or the request can be made again, correcting existing shortcomings.

Procedure and deadlines for making a decision

The Pension Fund considers a request to receive a one-time payment for 1 month. After a positive decision, money is transferred to the applicant’s account within 30 days. One or both parents may be denied payment if they were prosecuted for crimes against children or were officially deprived of parental rights by a court. It will not be possible to receive a one-time payment from the state budget if it has already been received earlier. The Pension Fund may reject an application for payment if:

  • the documentation is not completed correctly;
  • capital has already been spent;
  • the validity of the MSK certificate has been suspended;
  • the applicant provided incomplete or inaccurate family information.
