Is it possible to return children's products? Can children's toys be returned to the store? Are children's items returnable?

Purchasing toys is a significant expense for parents. Children crave new objects for entertainment every day, and on holidays they order especially desirable, and, as a rule, expensive toys. But what to do if you didn’t like the gift, or even turned out to be defective? Is it possible to return a toy to the store if there is a defect in it or the child simply does not appreciate the purchase? We will consider these questions today.

A parent may have many reasons to return a previously purchased children's toy to the seller. The most obvious are manufacturing defects in the product or its malfunction, discovered already at home. Also, the baby may simply not appreciate the parent’s purchase, or may receive two completely identical toys as a gift. When these situations occur, a natural desire arises to return the unsuitable product, taking the money, or exchange it.

Not all stores meet customers halfway and agree to accept children's toys back. First of all, this has to do with the letter of the law. From a legal point of view, the following types of toys cannot be returned or exchanged:

Table 1. Goods that cannot be exchanged if they are of proper quality

ProductPhoto
Rubber inflatables (balls, lifebuoys, mattresses, items intended for swimming and bathing)
Soft, no matter the size
For babies (teethers, rattles, pacifier holders)

The listed product groups cannot be returned when the toys are in in perfect order and simply did not fit due to color, size or other reasons. If any of the toys included in the three named categories has defects or defects, you can safely return or exchange it.

The same applies to electronic toys: if they are completely functional, the store is unlikely to agree to a refund. These products are technically complex and, according to the law protecting consumer rights, cannot be returned to the seller without a compelling reason. Thus, a radio-controlled helicopter, an electric car or musical toy instruments cannot be returned simply because they did not fit or were not liked.

All other toys can be exchanged or returned without explanation, but subject to certain conditions:

  • less than 14 days have passed since the date of purchase;
  • the toy is in good condition, the toy has not been used;
  • the buyer presented a cash receipt or remembers exactly the date and time when the goods were “punched” at the checkout.

Important point! The absence of a receipt is not an obstacle to returning the goods, provided that two other conditions are met. According to Article No. 18 of the Consumer Rights Law, the seller does not have the right to refuse to satisfy the buyer’s demands just because the latter cannot provide a cash receipt. This information is duplicated in Article 493 of the Civil Code of the Russian Federation. It is enough to indicate on what day the purchase was made so that the fact of the purchase is confirmed by information taken from the cash register or an entry in the purchase journal.

Ensuring the safety of the packaging is also not the responsibility of the consumer. It is logical that when opening a toy, it is easy to damage the box or other packaging material in which it was sold. Therefore, violation of integrity does not affect the successful outcome of the money return process.

According to Article No. 25 of the law protecting consumer rights, if a toy does not suit the buyer in size, color or other parameters, you should only apply for an exchange and not a return Money. Only if the retail outlet does not have a toy for which the exchange will be full, the consumer can demand a refund.

Another reason that can be cited when returning any toy is misrepresentation during purchase. According to Article 10 of the law protecting consumer rights, the seller is obliged to fully inform the buyer about all the features of the purchased product. Even if a sales consultant was not involved in choosing a toy, the necessary data should be reflected on the packaging.

In the code of laws on consumer rights, Article No. 12 states: the seller is obliged to accept goods from a person who was not provided with full information about the characteristics of the toy. Exhaustive list of important characteristics:

  • the country in which the toy was produced;
  • materials used in production;
  • contact details and address of the importer;
  • Name;
  • age of the toy (at what age is it allowed for children);
  • labeling and trademarks confirming quality;
  • information on toy care and storage;
  • safety measures when handling the toy;
  • assembly instructions, if necessary;
  • release date of the toy, batch number;
  • best before date.

You must ask the seller for a certificate confirming the authenticity of the toy. If there was none, or the paper was fake, and the buyer discovered at home that he had purchased a fake, this is also a reason for a legal refund.

To purchase soft toys need to be approached with special attention- they cannot be returned without a reason

What is the buyer entitled to?

Depending on the current situation, a person who wants to return a toy to the store can choose several options. If the toy simply does not fit and has no defects, and also does not belong to the “non-returnable” category, it is more logical to demand a refund from the store. If the claim against the store is based on a malfunction of the toy, the buyer can demand:

  • a discount commensurate with the detected defect;
  • replacement with a similar working toy;
  • repair and elimination of deficiencies;
  • reimbursement of funds that will be spent on independent repairs or have already been spent;
  • full refund of the money paid for the toy.

How to proceed to return a toy to the store?

In some cases, a verbal contact with a store representative and a description of the situation is sufficient. Lawyers advise not to contact the seller, but directly to the administrator or director of the store - this way the negotiations will proceed more quickly. We recommend that you behave kindly and speak assertively, but politely. Personal attitude towards the buyer can play a significant role in an amicable resolution of the issue.

If the store turns out to be sufficiently customer-oriented or the reason for the return is compelling and obvious, you will be asked to write a return application and will give you money in exchange for the product. If store representatives do not cooperate, you will have to file a written complaint. It must indicate the addressee of the message; usually complaints are written to the head of a specific outlet. Information about it can be obtained at the reception desk in the store or searched on the Internet.

You also need to provide your full details and contact information. It could be Email or number mobile phone. In the "body" of the claim in free form its essence is stated.

Let's look at the example: “Claim. On March 27, 2018, I, Sergey Tarasovich Olenev, purchased a toy “Interactive Ball” at the price of one thousand five hundred rubles 00 kopecks in the “Children’s Joy” store, located at Moscow, Lenin Street, 6. During operation, it turned out that the toy has defects in coloring, and is also not suitable for a child under one year old; it does not contain information about the age limit on the packaging. In this regard, I ask you to return the money in accordance with Article No. 18 of the PZPP. Date of. Signature".

You need to make a claim in two copies, or ask the store employees to make a photocopy. Both documents must be signed by both the buyer and the representative of the retail outlet, indicating the date of writing, and, accordingly, receipt of the claim. The store representative must indicate his full name, as well as confirm familiarization with the document with a company seal.

Documentary return formalities

If a person applies for a refund on the same day that he purchased the toy, he will be issued a refund at the same checkout where the payment was made. The only thing required is to write an application addressed to the store director, the contents of which will be suggested by the administrator. Usually the money is returned immediately, on the spot. When paying in cash, the refund is also issued in cash from the cash register; if the person paid with a bank card, the funds will be returned to it.

If the return is not made on the day of purchase, the return will be made from the main operating cash register of the store. In this case, the buyer must have a passport with him. You also need to write a statement demanding a refund, which also indicates the reason why the toy is being sent back to the store and the consumer’s personal data. The seller has the right to refund the money within ten working days.

Important point! Returns of low-quality goods can be made not only within two weeks of purchase, but throughout the entire warranty period or shelf life of the toy. That is, if the product breaks after 14 days, but the warranty period for it is one year, you can contact the store within this year. If the expiration date or warranty is not specified, the law establishes that the consumer can return a low-quality toy to the store within two years from the date of purchase.

What to do if the store refuses to issue a return?

If the seller refuses to accept the claim, remind him of Article No. 13 of the law protecting consumer rights. It states that for failure to comply with the voluntary procedure for satisfying consumer demands, a fine of half the cost of the goods may be imposed. Lawyers recommend filming what is happening with a mobile phone camera in order to have factual confirmation of the store’s illegal measures. However, even in case of refusal, there is no need to argue and quarrel with sellers - the claim is sent to them in the form registered letter, upon receipt of which the representative of the retail outlet will be required to sign the postal form. This records the moment the addressee received the claim.

The seller who does not agree that the toy is defective has the right to send the goods for quality control, carried out at his expense. If the inspection reveals a malfunction, but the store representative insists that the consumer’s actions led to it, the toy is sent for examination. It is carried out at the expense of the seller within ten days, but if the buyer is found to be at fault for damaging the toy, he will have to pay for the work of the experts.

A buyer who is not satisfied with the results of the examination or the seller refuses to return the money without conducting an inspection can go in two ways:

  • contact Rospotrebnadzor with a request to help restore consumer rights;
  • go to court.

The latter implies considerable moral and financial costs, as well as the need for the services of a lawyer. If the toy costs little money, this is considered inappropriate. If we are talking about an expensive acquisition, it makes sense to defend your rights and money in judicial procedure. Also, through the court, you can obtain a penalty from a store that did not pay the money on time. For each day of delay, according to the letter of the law, a penalty in the amount of 0.5% of the amount of the goods is charged. To recover these funds, you also need to go to court.

Info

How can I return defective clothing items? Parents who, after purchasing children's clothing, discover defects in the form of uneven coloring after the first wash, missing buttons and other parts, have every right to return the item to the store. The procedure is similar to the scheme for returning good quality clothing, with the only difference that here you will have to conduct expert research if the seller refuses to resolve the dispute peacefully. Based on the decision of the examination, the money is returned or not returned.

Important

Firstly, any adult who was near the buyer at the time of the purchase and sale transaction can testify in favor of the client. Secondly, sales history is tracked in the cash register. If all these conditions are met, the buyer can go to the store without fear and assert his rights.

A passport or other identification document will definitely come in handy here, since you will have to fill out a claim application for an exchange or return of an item. The store will refund the money if more than 2 weeks have passed from the date of purchase. The day of purchase does not count. To accurately calculate the number of days given for a legal return, you should add 14 days to the day of purchase and get the date last day appeals.

Buying clothes for children is another task for parents. In addition to the obvious investment of time, money and effort, it is necessary to be vigilant, select good quality, and also so that the child looks presentable in all this splendor. Of course, this does not always happen.

While shopping with your children, you may find at home a depressing lack of combination of styles, colors, or even a mistake in size. Not to mention situations where what you bought a few days later becomes a very clear example of a blatant lack of production quality.

What to do in this case? Of course, return what didn’t fit. The child grows very quickly, and clothes have to be purchased quite often, and unnecessary things should not be in the wardrobe at all.

Is it possible to return?

The Law “On Protection of Consumer Rights” does not distinguish between adult clothing and children’s clothing. The only exceptions are very specific things for very young children, but they fall under special lists.

Otherwise, children's clothing items are returned in two directions:

  • Return of items that do not fit in size, style or color;
  • Returns of items that cannot be used due to faulty, short or defective fabric/accessories.

In these two cases, different return paths are applied, and different time limits and possibilities are imposed. If you are going, please keep in mind that hygiene items and inflatable rubber children's toys cannot be returned.

How to return or exchange

First of all, you need to draw up a return application according to the above categories. In this document, you will list why you decided to return the clothes you bought for your child, and what you want to receive in return from the store.

High quality

Clothing items are considered to be of good quality when:

  • They kept their appearance, allowing them to be hung back on the hanger in the store and sold to someone;
  • They kept their tags, labels or stickers, again allowing them to be sold again to another buyer;
  • They were not worn, but only tried on;
  • They still have their properties and are ready to perform their immediate function.

If all these conditions are met by you, the refund is made within the first two weeks from the date you made the purchase or received the parcel (if you ordered clothes from an online store). By writing a statement, you can demand that the store exchange a quality item for other quality clothing that will suit you better.

Do not rush to demand money back - this is unlawful at this stage of the request, and may lead to an immediate refusal.

It is possible to receive funds, but the requirement must be specifically about the exchange. By law, the seller is obliged to provide you with possible analogues of children's clothing that would “suit” you, and you will have to claim that in everything model range Nothing in the store “suits” you. Sometimes the seller may offer you an item of clothing that will still fit and ask you to wait until it appears on the shelves.

It’s better to give up everything and get the money back to buy something else for your child.

Poor quality

No one is safe from defects, especially considering that even famous brands prefer to use cheap labor in clothing factories. It should be noted that any product you purchase must have a manufacturer's quality guarantee. You are used to the fact that only equipment has a warranty, but this is not the case. The law establishes the impossibility of selling low-quality goods to consumers; accordingly, all clothing must be of high quality.

If this does not happen, and after some time, through no fault of your child, the paint begins to slip, seams become twisted, decorations fall off, or threads come off, the product is of poor quality. They must take him back.

However, there is a pitfall here in the form of a mandatory expert assessment of damage to children's clothing. Most often, people refuse to take a defective item to a store with a claim for return because they are afraid of not passing inspection. And rightfully so - after all, store experts are quite biased, especially when it comes to children. Has your seam come apart? It was your child who jumped hard. Has the paint come off? I was experimenting with friends on the street and spilled peroxide on my trouser leg. The store has a lot of excuses, so it’s better to conduct an independent examination. The store will be required to accept its results.

So, Returns of low-quality children's clothing are made:

  • Within the warranty period (by law - two years, for shoes - seasonal periods) established by the manufacturer;
  • If there is an undeniable factory defect or a store defect;
  • If there is a purchase receipt or witnesses;
  • By filing a claim with the store.

At the same time, if, after all, the clothes are found to be of poor quality not because of your actions, the store can offer you:

  • Exchange the children's item for the same one, only without the identified defect;
  • Exchange a child's item for another, calculating a different purchase price;
  • Return the funds in full;
  • Correct the clothing defect at your own expense;
  • Reduce the cost of your purchase in proportion to the defect in the clothing.

Important! Be sure to include one of the above requirements in your complaint, and also duplicate your appeal.

The store employee is required to put a mark on the document indicating that he has accepted your requirements for consideration. They should answer you within 10 days (if you need serious expertise, within a month, but sellers rarely delay that long). If you have not been contacted after these deadlines, you can request immediate payment of the funds spent on the purchase of children's clothing.

What clothes cannot be returned?

You cannot return quality clothing that:

  • Refers to hosiery (gaiters, socks, tights);
  • Refers to ;
  • Refers to swimming accessories - swimsuits, swimming trunks;
  • (like panties for newborns with the function of a diaper or diaper);
  • Refers to sewing products - usually included here.

You cannot return low-quality clothing that:

  • It became like this through your fault or the fault of your child;
  • Officially worn out;
  • Returned after the end of the warranty period.
