  7. Design documentation for the maintenance of various hydraulic and ship structures and structures, which is necessary to ensure their reliable operation, track work and navigation safety.
  8. Technical documentation for the replacement or repair of industrial, technical and other equipment, machines, mechanisms or units, which is developed and approved by specially authorized bodies in a certain area in accordance with all necessary regulations, and which does not require any or construction work.
  9. Design and estimate documentation, in which any changes have been made building materials, equipment or products with similar ones and the replacement of which will not affect the main supporting structures.
  10. Project documentation for linking standard projects or projects that are reused for the construction of individual residential buildings or social facilities.

According to federal legislation, design documentation for the following capital construction projects does not require state examination:

  • separate residential buildings with a height of no more than three floors, intended for residence of no more than one family;
  • multi-apartment residential buildings, no higher than three floors, which can consist of no more than four sections with apartments, premises for common use and separate entrances;
  • detached residential buildings, no higher than three floors, which may consist of no more than ten blocks, each of which is intended for the residence of only one family and has one or more common walls without openings;
  • detached non-production facilities that are not intended for civilian residence, no more than two floors and a total area of ​​no more than 1,500 square meters (with the exception of technically complex or dangerous objects);
  • stand-alone production facilities with a height of no more than two floors and a total area of ​​up to 1,500 square meters, for which there is no need to establish sanitary protection zones (with the exception of technically complex or dangerous facilities).

Despite the fact that all of the above cases do not require a strict examination of project documentation and the issuance of an expert opinion, nevertheless, the development of technical, design and estimate documentation is necessary.

State examination of design documentation has been carried out since January 1, 2007. It replaced a complex system of inspections that existed for a long time in our country and was carried out in several stages. The authorized body responsible for its implementation is Rosstroy, or rather, the Federal State Institution “Glavexpertiza of Russia”, which is subordinate to it.

There is a list of objects that undertake to conduct state examination. These are the objects:

– used for military protection state and its security;

cultural heritage, unique in their kind, and possessing federal significance;

– technically complex;

– potentially dangerous or classified as “secret”;

– being built in territorial or internal sea ​​waters or on the continental plume;

- being built in a certain economic sphere or on a site that is located in several regions of the country.

Non-state examination of project documentation: who should carry it out

This examination is carried out by government agencies of a specific subject of the Russian Federation that have authority in this matter. Also, this right is granted to organizations that have undergone the confirmation procedure in accordance with Article 50 of the Civil Code of the Russian Federation and received the right to conduct an inspection of this level.

Non-state examination of design documentation is carried out for other structures that do not fall into the group of objects of federal significance. When is examination of design and estimate documentation required?

An examination of design and estimate documentation is required when real estate of federal significance and any buildings of constituent entities of the Russian Federation are being built. Projects under construction may have all sorts of ownership options and financing sources.

There is a whole list of official documents submitted for examination of design and estimate documentation. It is regulated by special rules of the Russian Federation and building codes.

When examination of design documentation is not required

To organize the examination of project documentation, the following documents are needed:

– description of work by sections of the project;

– feasibility study;

– initial information for design;

What is the procedure for examining project documentation?

The Town Planning Code does not provide a clear definition. Is examination of project documentation necessary when making changes to the project?

Sometimes after a successful examination of project documentation changes are required to the project. The question naturally arises: is it necessary to repeat this procedure? The Town Planning Code and Resolution No. 145 say in this regard that a re-examination of the revised project is required if:

  1. The amendments affected technical solutions, affecting the structural reliability and safety of the capital construction facility. Re-examination of project documents is carried out in the same order as the initial one. However, in this case, only the corrected part of the project and its compatibility with the rest of the documentation will be analyzed. The only case when it is carried out expert analysis of all revised project documentation, is to introduce changes to the legislation affecting the results of the initial examination.

What to do if the results of the examination are negative?

If the result of examination of project documentation If there is a negative conclusion, then the customer has two options:

  1. Challenge the conclusion of the expert organization in court or the Ministry of Regional Development.
  2. Eliminate these comments and undergo the examination again.

It must be borne in mind that in practice, challenging the conclusion of experts in judicial procedure It is worth it only if there are sufficient grounds to assume that the analysis was carried out erroneously with a negative conclusion in the end. The second option may be more effective, since it only requires corrections to the specified comments. Moreover, if changes can be made to the project without returning the documentation, the expert organization has the right not to return the project on paper to the applicant. The nuances of conducting an examination of project documentation in a non-state form

If examination of project documentation decided to be carried out in a non-state form, it is very important to check the powers of the performing organization regarding the performance of expert work of this kind before concluding a contract.

The right to conduct examinations is given by accreditation, which is confirmed by a certificate issued Federal service for accreditation (Rosaccreditation). The certificate must contain:

  • data from the organization providing project review services;
  • a list of types of expert work for which the company is accredited;
  • seal of the Federal Agency for Accreditation and signature of the official.

At the time of the examination, the accreditation certificate must be valid (i.e. not expired).
