Without police, excitement and mistakes

At a traffic light, they drove into the back of your car.

There is little damage: a dent in the bumper, a bent license plate and a broken fog lamp. The second driver does not refuse his guilt.

With the call of the police, it will take half a day to process the accident. And this is not counting the need to go to the department for a certificate of an accident, without which you cannot receive a payment for OSAGO.

But you can keep within one hour and not go to the authorities for information. To do this, it is enough to issue an accident according to the European protocol.

In short: how to draw up a European protocol

  1. Carry an accident report form with you. It is issued free of charge in any insurance company.
  2. Install the application "Accident Europrotocol" through Epstor or Google Play.
  3. Make sure that your accident complies with the requirements of the Euro protocol.
  4. Fill out and sign an accident notice - this is a paper version of the Euro protocol.
  5. Take pictures of the damage, circumstances of the accident and documents.
  6. Determine the address and coordinates of the accident.
  7. Send everything to a single system through the application and wait for confirmation. If both parties involved in the accident are using the app, they don't need to go anywhere else.
  8. Bring the completed paper notice to the insurance company where you purchased the OSAGO policy.
  9. At the office of the company, write a statement of loss according to the model accepted in the company.
  10. If you are the culprit of an accident and have issued everything according to the European protocol, be sure to inform your insurance company about the fact of the accident within five days.

What to do after an accident

The actions of participants in an accident after an accident are prescribed in the rules of the road. Regardless of who is responsible for the incident, follow these steps:

  1. Stop. If you go out on the road - take precautions, put on a reflective vest.
  2. Turn on the hazard warning lights and set the warning triangle.
  3. Don't move items related to the incident.
  4. Find out how many people were involved in the accident and if there were any casualties. If there were none and only two cars participated, they draw up a European protocol without calling the traffic police. If more than two cars got into an accident or there are victims, it is necessary to call the police and an ambulance for the victims.
  5. Take first aid measures if there are casualties. If the case is an emergency, take the victim to the hospital on a passing car or your own. In a medical institution, you will need to provide your data, the license plate of the car and the data of its registration documents, present a driver's license or passport. After that, return to the scene.
  6. Take all measures to preserve traces of the accident and organize a detour of the scene. You can clear the road. In this case, fix the position of vehicles in relation to each other, traces and objects related to the incident. It is allowed to use means of photography and video filming. When shooting, try to capture not only the damaged cars themselves, but also the place where the accident occurred: signs with house numbers, road signs, sidewalk, road markings. When you make a video recording, say everything that happens. For example, like this: “Today, November 11, 2019, at the intersection of Novaya and Tsvetnaya streets, an accident occurred - a collision of two cars: a blue VAZ-2109 belonging to me and a green Toyota belonging to a man who did not give his data, from the car refused to come out." Next, list all damage to cars.
  7. Write down the names and addresses of eyewitnesses.
  8. Wait for the police to arrive if called.
  9. If an accident can be registered without the police, proceed with the registration of the European protocol.

If these requirements are not met, the insurance company may refuse to pay out. Sometimes more severe consequences are possible. For example, leaving the scene of an accident is punishable by deprivation of rights.

What is Europrotocol

The European Protocol is a procedure for registering an accident without calling the police. Drivers on the spot fill out the documents on their own to receive the CMTPL payment and calmly disperse.

This practice has long been successfully applied abroad. Hence the name.

Europrotocol is valid throughout Russia. Even if your car is registered in Moscow, but you drove into it in Vladivostok, you can still use it.

For a damaged car according to the European Protocol, you can get no more than 100 thousand rubles.

The main provisions of the European Protocol are defined in the law "On Compulsory Insurance of Civil Liability of Vehicle Owners". All insurance companies that have a valid license for OSAGO are required to pay compensation for accidents registered without the participation of authorized police officers.

Moreover, the Europrotocol also works on voluntary car insurance policies - Casco. The Central Bank of the Russian Federation obliged insurance companies operating on hull insurance to include in the insurance rules a clause on registration of an accident without calling the police. If the accident complies with the requirements of the European protocol, the insurance client can claim a loss under the hull without any certificates.

From October 1, 2019, data on road accidents are additionally recorded and transferred to an automated system using electronic services. The insurance company must receive uncorrected photographs and coordinates from the satellite.

When can you file an accident without the traffic police

Before filing documents without the police, make sure that your accident complies with the requirements of the European protocol:

  1. Two vehicles were involved in the accident.
  2. Place of the accident - Russia. Many foreign countries have their own European protocol, but the Russian OSAGO policy does not work there.
  3. Only cars were damaged, there were no casualties or casualties. Other property - personal belongings of passengers, lampposts and road barriers - was not damaged.
  4. The future repair of the injured party's car will not exceed 400,000 rubles.
  5. Both drivers have OSAGO policies. If the second participant is a foreign citizen, then he must have a Green Card liability insurance policy. If this condition is met, then you can draw up documents according to the European protocol, even if the participants in the accident have disagreements about the circumstances of the accident and damage to the cars.

Make sure that the accident fits all five points, and proceed with the paperwork.

What to fill out on paper

To file an accident according to the European protocol, drivers need to fill out a single document - an accident notice. It is issued by insurance companies when buying an OSAGO policy. Notice forms can also be printed on a regular printer in at least two copies. The template can be downloaded from the official website of the PCA.

In the glove compartment of almost every car is one or two notice forms. It does not matter whose form will be filled out: the notification form is standard for all insurance companies. If neither you nor the co-driver have a form, borrow one from any driver passing by.

Check if you have an accident notice form in your car. Didn't find it? Contact the office of any insurance company - you will be given it for free.

In addition to the notice form, you will also need a ballpoint pen and a flat hard surface - a book, tablet or car hood. The notice is made of self-copying paper; when filling it out, you need to press the pen harder to make the copy readable. A gel pen, felt-tip pen or pencil will not work.

Photographing the crash site and damaged vehicles is optional. But still, it is recommended to take a few pictures on your smartphone just in case.

How to fill out the Europrotocol form

You and the co-driver must complete one accident report form.

On the front side

Enter information about your car in the left column "Vehicle" A "", and let the culprit fill in the right column "Vehicle" B "".

Vehicle damage. In paragraph 14, describe the damage to your car in as much detail as possible. The more specific the wording, the better.

Damaged bumper, license plate, fog lamp

Rear bumper - a dent in the central part measuring 10×10 cm and 3 cm deep. License plate - dented over the entire area. Fog lamp - outer glass broken

Damaged side door

Front left door - a dent in the lower part measuring 50x10 cm and 1 cm deep

Scratches on fender and bumper

Front bumper - deep scratches on the paint on the right side. Wing front right - scratches to the metal on the arch 10 cm long

If there is not enough space on the front side for all the damage, use the reverse side. In this case, make a note "Detailed damage on the reverse side".

Instead of a ruler, you can use a credit card to determine the amount of damage. Its standard size is 54×86 mm.

Often a car in an accident receives hidden damage that is not immediately visible. At the slightest suspicion of such damage, call the traffic police.

Remarks. In paragraph 15, the driver guilty of an accident must write the phrase “I admit my guilt in an accident. I have no complaints." If this phrase is not in the notice, the insurance company will refuse to accept documents and pay out according to the European Protocol.

Circumstances of the accident. In paragraph 16, check the boxes next to those items that relate to your accident. It is allowed to indicate several positions at once and at the end indicate their exact number.

In the event of a rear-end collision at a traffic light, select:

10 - Collided with a vehicle moving in the same direction in the same lane

Signatures of the parties. Before you put your signatures in paragraph 18, separate copies of the notice. On each form, sign yourself and ask the second driver to do this.

After you have signed the copies of the notice on the front side, proceed to fill out the back side.

On the reverse side

Each driver fills out his copy of the reverse side. Before that, you need to split the notice, otherwise the front side will become unreadable.

On your copy of the notice, you indicate the circumstances of the accident. Describe the accident as you see fit, but do not save paper and write in more detail.

If there is not enough space on the form for your version of circumstances, attach a blank sheet of paper and write all the details on it. At the top of the sheet, make an entry “Application to the notice of an accident” and put the date of the accident. In the form itself, make a note “Detailed circumstances of the accident in the Appendix”.

Important

The application must be signed by both drivers.

How to issue a Europrotocol through the application

After filling out the accident notification form, you need to transfer information about the accident, participants and damage to the unified compulsory insurance system. So far, one service has appeared for this - a special mobile application "Accident Europrotocol".

Here is what you need to do to fix the crash through the app:

  1. Take pictures of the damage, circumstances of the accident and documents. Take a photo of the accident site from three angles, and photograph each damaged part separately. Photograph the accident notice, but keep the paper version.
  2. Determine the address and coordinates of the accident. To do this, the machine must have a monitoring system.
  3. Send everything to a single system
  4. Wait for confirmation.

Where to apply for payment

If both drivers have completed and signed the accident report form, you can leave.

To pay under the European protocol, bring the completed notice to the insurance company where you purchased the OSAGO policy. There is no need to contact the company responsible for the accident. This procedure is called direct damages and has been in place since 2007.

At the company's office, you will be asked to write a statement of loss in the form and sample accepted by the company, and they will take copies of the documents for the car: vehicle passport or registration certificate, OSAGO policy.

Important advice for those who are to blame: if you are the culprit of an accident and have issued everything according to the European Protocol, be sure to inform your insurance company about the fact of the accident within five days. Otherwise, the company may require you to compensate the payment to the victim.

Documents for payment can be submitted remotely, for example, by downloading copies through your personal account. The original documents are transferred during the inspection of the machine.

The amount of payments under the Europrotocol

Payments depend on the damage caused. The maximum amount is determined by the state. If there were victims in the accident, they can pay up to 500 thousand to each victim, but in this case, an accident is issued only through the traffic police. The maximum amount of payments under the Europrotocol in 2019 is 400 thousand rubles.

This does not mean that each victim will automatically receive 400 thousand for a dent in the wing. The insurance company will conduct an assessment and pay the actual damage in accordance with it. If the amount of damage is more than 400 thousand rubles, you can demand the difference from the culprit in court.

Remember

  1. For small accidents with two participants, you can not call the traffic police and arrange everything yourself within the framework of the European protocol.
  2. According to the European Protocol, one document is filled out - a notice of an accident, and the documents are immediately sent to an automated system along with photographs of damage and coordinates of the accident site.
  3. If in doubt about the amount of damage, don't risk it. It is better to call the traffic police and require them to file an accident.
  4. Documents under the European protocol must be submitted to the insurance company where you bought the OSAGO policy.

Europrotocol has firmly entered the life of motorists and has become a popular option for registering an accident. The question of how to draw up a Europrotocol in case of an accident is faced by most drivers. Therefore, it is recommended that you familiarize yourself with the existing terms and conditions in advance in order to optimally protect your interests. The modern way to legalize an insurance situation that has arisen is convenient, but has special conditions and restrictions.

A legal document that allows you to resolve an emergency without the participation of the traffic police is called the Europrotocol.

Incident data is filled in on a unified form that has a form approved at the federal level.

Participants in the incident fill out standard forms on their own, without calling traffic police inspectors.

Documents that mutually satisfy the parties to the accident become the basis for the payment of insurance compensation for OSAGO.

Important! Drivers got the opportunity not to obstruct traffic on the highway, pull over to the side of the road and calmly solve their problems without creating traffic jams.

The European protocol is valid in all regions, two sets of forms can be obtained when applying for an insurance policy.

If the issued copies are not enough for the driver, then the insurer is obliged to issue an additional set at the first request of the client. Forms are issued free of charge, their number is unlimited, when compiling a notice, you can use a copy of any participant in the incident.

You can print the protocol on the RSA website, the law allows you to use this type of document.

A well-filled accident notice will allow you to get OSAGO insurance without disputes.

To avoid difficulties and conflicts with the insurance company, you should know exactly how to issue a Europrotocol in case of an accident.

In what case is the Europrotocol filled out in case of an accident?

First of all, the driver should have an idea of what to do in case of an accident.

It is not always possible to issue an accident according to a European notification; the following requirements will need to be met simultaneously:

  • the number of participants in the incident cannot be more than two, only they and no one else received damage and damage;
  • drivers, passengers or third parties were not injured in the accident, did not suffer physical damage;
  • both drivers have an OSAGO policy or a Green Card (insurance in a foreign territory);
  • there is solidarity between drivers in the vision of the accident, in other words, citizens agree on who is guilty of the accident, what is the amount of compensation;
  • the cost of damage and the required compensation falls within the limits established by the rules.

If the vision of the event is different for each side or there are complaints, then the traffic police will have to be called.

Registration of the Europrotocol is permissible only with the mutual desire of the participants in the event. If the other party behaves inappropriately, the driver is clearly drunk, then you should not draw up a notice of an accident.

Attention! If the car is insured under CASCO, then check the clause of the agreement on the possibility of applying the Europrotocol. In the vast majority of cases, the presence of traffic police officers at the scene of an accident is required.

What to do if you get into an accident? First of all, you should calm down and visually assess the amount of damage, exclude emotions and focus on how to draw up a Europrotocol in case of an accident.

What to do in case of an accident, the sequence of actions of the participants in the accident:

  • Make sure no people are hurt and only two vehicles are damaged.
  • Check that both parties to the incident have an OSAGO policy.
  • Find out the circumstances and come to an agreement on the culprit of the event.
  • Both drivers have the right to take a panoramic picture of the accident site, the location of cars, and the trajectory of movement. The more factual material is obtained, the fewer questions will arise from insurers in disputable situations. Both cars must be close-up shots with license plates visible.
  • Having testimonials would be a big plus. The personal data of witnesses, their written statements will form the basis of the truth of the stated requirements.

The procedure is quite simple, but the implementation requires mutual and coordinated actions of drivers.

How to draw up the Europrotocol in case of an accident?

In order to correctly draw up the Europrotocol, it is recommended to fill it out with a ballpoint pen, try to avoid corrections and dubious points.

The document consists of three sheets fastened together, two copies of the protocol and instructions for filling out.

The protocol is filled in by both drivers, and the carbon copy allows you to display two copies at once, for each of the participants in the accident.

Then the sheets are divided, and the reverse side is filled in by each citizen individually.

The document contains a significant number of points that allow you to fully reveal the nature of the event, the damage and the actions of the participants. An admission of guilt by one of the parties is necessarily displayed, personal signatures are put under the displayed information.

Important! Insurance indemnity is not more than 50 thousand rubles. If the event occurred in Moscow, St. Petersburg and their regions, then an amount of up to 400 thousand rubles can be indicated in the protocol. The UK will require the provision of photographs, indication of the coordinates of the incident by GLONASS. The place of registration of the owner and the car are not taken into account, the rule applies to everyone.

When filling out the protocol, drivers independently choose column "A" or "B", enter the necessary information with their own hand. It is recommended that you carefully consider paragraph 14, which describes the external damage to the car. It is possible to use such terms: dent, scratch, tear, crack or deformation. It is necessary to describe the damage inflicted briefly and meaningfully so that there are no questions left when coordinating the recording and photographs.

You can use the sample of filling out the Europrotocol, which is located on the PCA website, as well as at the bottom of the article.

Pay attention to the important point 16, which indicates the circumstances of the event. The direction of movement of both cars, the speed and the cause of the collision are necessarily displayed. At the end, a mark is placed on the number of completed points in the designated field of the enlarged format.

The scheme of the incident is recorded in paragraph 17, including the contours of the carriageway, the names of streets and other landmarks (outside the city, on the highway). If there are traffic lights, intersections, road markings or other additional landmarks in the accident area, then the data must be displayed without fail.

Attention! Sometimes drivers have information that does not fit the descriptions of the listed items. The data can be entered in a special paragraph 15 "Remarks". If there is not enough space on the back of the form, you can continue writing on a blank sheet. In this case, you will need to write down “with an application”, indicate what the continuation refers to, and sign the participants.

It is necessary to know in advance how to draw up the Europrotocol in case of an accident, otherwise the insurer will have to collect the necessary data on their own. This may not only delay the receipt of compensation under the policy, but also allow the insurance company to challenge the insured event.

Millions of cars are produced every year in the world and our roads are becoming more and more congested. As a result, the number of accidents on the roads is growing and, sometimes in large cities, traffic police simply do not have time to quickly arrive at the scene of the accident when called. Abroad, a system was developed for registering an accident on the spot without the need to call special services, which greatly facilitated many moments. Recently, such a system has been operating in Russia. So what do our drivers need to know if they have an accident and want to handle everything themselves? In this article we will talk about how to fill out the Europrotocol in case of an accident sample 2017 with a brief description.

Europrotocol is a procedure for processing documents in case of an accident on your own, without the presence of traffic police officers. Drivers will fill out the form themselves at the scene of the accident, which will save time and allow you to quickly eliminate traffic jams, freeing it for the passage of other vehicles.

But you should be aware that not in all cases it is possible to draw up such a protocol.
We list the situations in which drivers can safely draw up a protocol on the spot:

  • if in the event of an accident both vehicles are insured under OSAGO;
  • in the absence of disagreements among the participants in the accident on the current situation;
  • if no more than two cars were involved in the traffic accident;
  • in the absence of injured or dead people (passers-by, pedestrians, etc.);
  • if additional property was not damaged during the incident

Registration of such a protocol cannot be carried out and drivers will need to call the traffic police if:

  • there are injured or dead people;
  • more than two vehicles were involved in the accident;
  • in addition to cars, additional property was damaged;
  • road accident participants have obvious disagreements and do not want to draw up documents themselves;
  • if at least one of the drivers does not have OSAGO insurance

Leaving the scene of an accident. What is the punishment in 2016-2017

Leaving the scene of an accident

Leaving the scene of an accident is an administrative offense, according to which the offender must be held accountable. Since no amendments or changes were made to the Code of Administrative Offenses in 2015, the violator will also be punished in 2016-2017 in accordance with Part 2 of Art. 12.27 of the Code of Administrative Offenses.

These penalties can be of two types:
- deprivation of a driver's license for up to one and a half years
- arrest up to 15 days

However, when drawing up a protocol with the implementation of all necessary actions on the spot, the driver can safely leave the scene.

How much damage can be covered?

According to the OSAGO insurance policy, the payment of the amount of damage is not more than 50 thousand rubles, provided that the insurance contract was signed after 08/02/2014. Prior to that, the amount was less and amounted to 25 thousand rubles.
However, if both cars at the time of the accident had a satellite navigation system that recorded the incident, then the limit on the amount of payment under the European protocol increases to 400 thousand rubles. This law applies to Moscow and the Moscow region, St. Petersburg and the region. The list of navigation satellites that are approved and allowed during the execution of this procedure are indicated in the relevant OSAGO documents.

Procedure for an accident

Registration of the Europrotocol in case of an accident 2017 procedure:

  1. Stop the car and put an emergency stop sign;
  2. Collect contacts of witnesses of the incident;
  3. Do not remove traces of the accident and, if possible, take pictures of the situation:

-general, panorama with full view of the accident
- tire marks
- vehicle breakdowns
-view of cars from the outside, their location
-state car numbers
- individual damaged parts

So, if drivers see that it is permissible to draw up a European protocol in the event of their traffic accident in order to alleviate the situation and not wait for the traffic police, they will have to fill out a form. In theory, each driver has a form, but only one of them will need to be filled out. Which one, it makes no difference. The form consists of two columns, where one is assigned to one driver, the other to another.

The first thing to do is to check that the form is not damaged and that all the data on it is clearly printed. Then each driver selects a column for himself and enters all the necessary data about his car.

Rules for filling out the form - Notices:

How to fill out the Europrotocol correctly

So, let's consider how to fill out the Europrotocol in case of an accident 2017 registration rules:

  1. You need to fill out the form exclusively with a ballpoint pen (fountain pens and pencils are not accepted. The first ones can be smeared on paper, and the pencil can be completely erased).
  2. First you need to fill in the front side, where there are two columns, for each driver separately. A more detailed description of filling will be described later.
  3. Then both drivers are required to fill out the back of the form, indicating all the necessary data. This information is also important, because the insurance company will take into account your personal notes in the proceedings in the case.
  4. Copies filled on the front side must be separated after filling.
  5. Each driver must put two signatures on the front side. One will be under the filled information, the second under the item "Consent"
  6. If any changes were made after the form was split, the driver must sign that he is not opposed to the amendment of the document by the other driver.

Detailed instructions for filling

How to draw up a Europrotocol in case of an accident 2017 sample:

Scheme of registration of an accident

Items 1 to 8 require you to fill in general information about the accident

  • Place of the accident - the exact address is entered as required by the paragraph;
  • Date of the accident - enter the exact date and time in the allotted boxes;
  • The number of damaged vehicles - a number is entered in the box;
  • The number of wounded (persons who received bodily injuries) - the number is entered into the box, then the number of the dead is entered into another box;
  • Whether the road accident participants were examined for intoxication - marked in the Yes or No box;
  • Material damage caused to other vehicles (except for "A" and "B") - it is necessary to mark Yes or no, to other property - Yes or no. (mark according to circumstances);
  • Witnesses to the accident: - Ivanov Ivan Ivanovich, Moscow, st. Green, d.33;
  • Whether registration was carried out by a traffic police officer - mark No

- Starting from point 9 and up to 15, each driver fills in separately, entering information about himself and his vehicle, as well as about insurance.
— Particular attention should be paid to paragraph 14 of the Notice, which will describe the damage that was caused as a result of a transport accident. You also need to make sure that the other driver does not embellish his breakdowns and damages and truthfully describe his situation.
- It is in the interests of each driver to correctly describe paragraph No. 16, where it will be necessary to display under what circumstances the traffic accident occurred. The description should be, first of all, truthful, without exaggeration and concise. If there are any hidden damages in the car, then they should be checked by an expert.

It is necessary to write in precise terms that reflect the essence, for example, there is a difference in meaning - the driver overtook the car or changed the lane. From what exactly he did in this situation may depend on who is responsible for the incident.

- In the next paragraph No. 17, a clear accident diagram should be drawn, where you need to indicate the names of streets, the traffic pattern of cars, traffic lights, pedestrian crossings, as well as any other items that could affect the current situation on the road.

There is also a “Remarks” item in the form, where you can add something that did not fit in other items or enter something else if the driver wants to emphasize some point.

After filling out, both participants in the accident put their signatures, thereby confirming that they fully agree with the information provided. It is worth checking not only your own bollard, but also the bollard of the other driver, in order to avoid further misunderstandings. Once signed, the form is divided into two parts. Signatures are put on both parts - your own and the form of another driver, thereby confirming that you agree and are familiar with the information provided by him.

The back side of the form is filled out after the division of the Notice, i.e. each driver separately. On it, the driver can indicate any additions, notes and notes. In case there is no more space, it will be necessary to write “with attachment” on the form and supplement what was not enough space on a simple blank sheet by attaching it to the Notice.

In the event that the completed form is damaged, lost, or one of the parties wants to make some changes to the information, a new form should be filled out.

Drivers wishing to carry out registration of an accident according to the European protocol should know that:

  1. You need to apply to the insurance company as soon as possible, within 5 days
  2. When applying with you, you need to have the following documents:

- completed signed form
- a statement that all the information you provided is true and written by you personally
- claims for damages
- all photographs taken (the list is described above)
- recording from a camera or DVR must indicate the date and time of shooting
- the injured party will need to attach a claim for damages
-The insurance company has the right to ask to provide a car for examination
- Drivers are not allowed to return the car for repair within 15 days after the accident

Drivers should take into account that after submitting all the documents to the insurance company, on the basis of the data provided, proceedings will be conducted, after which the amount, compensation according to the European protocol, will be assigned.

The maximum payout amount has already been described above. Many drivers ask themselves: Where can I get the Europrotocol? If the driver already has insurance, then the insurance company provides such a protocol itself. And the form of the Europrotocol in case of an accident in 2017 can be downloaded in this article, as well as a sample for filling out.

The appearance of the Europrotocol on the territory of the Russian Federation certainly facilitated the process of registration of traffic accidents. But our drivers must know step by step how to act in such a situation, what should be done and in what sequence. It is also important to orient yourself with filling out the forms. Therefore, if the driver still chooses OSAGO insurance with the intention that it may be useful when drawing up such a protocol, then he should familiarize himself with all the rules in advance and know how to draw up a Euro protocol in case of an accident. This will greatly simplify the design, if the time comes, and give more confidence to the driver.
